Indian-American Lawmakers Criticize Trump’s Executive Order on Birthright Citizenship

Indian-American lawmakers strongly oppose U.S. President Donald Trump’s executive order restricting birthright citizenship, which declares that children born to undocumented immigrants or certain legal temporary residents, such as those on student or H-1B visas, will no longer be granted U.S. citizenship. The order, signed on January 20, 2025, challenges the 14th Amendment’s long-standing guarantee by asserting such children are not “subject to the jurisdiction” of the U.S.
Congressmen Ro Khanna, Shri Thanedar, and Congresswoman Pramila Jayapal criticized the move as unconstitutional and harmful to legal immigrants, particularly impacting skilled Indian professionals on H-1B visas. Immigration rights groups and 22 state attorneys general have filed lawsuits to block the order, arguing it violates constitutional precedent. The policy is set to take effect on February 19, 2025, if upheld.
