Gujarat Government Expands Workforce Flexibility with New Labour Ordinance

On July 1, 2025, Gujarat introduced the Factories (Gujarat Amendment) Ordinance, 2025, amending the Factories Act, 1948, to offer greater flexibility for both employers and workers.

Key highlights include:

  • Extended daily work hours: Workers can now work up to 12 hours a day (previously 9), provided they don’t exceed 48 hours per week, and give written consent .

  • Continuous work intervals: The maximum uninterrupted working period can increase from 5 to 6 hours, subject to notification and consent.

  • Overtime enhancements: The overtime cap has increased from 75 to 125 hours per quarter, with the guarantee that overtime is compensated at double the regular rate, again requiring voluntary agreement.

Women’s night work policy:

  • For the first time, women are permitted to work night shifts (7 pm–6 am), but only with written consent and under 16 stringent conditions.

  • These include proper lighting and CCTV coverage, female security staff, a minimum batch size of 10 women, safe transport arrangements, redressal systems for sexual harassment, and more.

  • Importantly, no woman will be compelled to work nights—it’s entirely optional and regulated.

The government justifies the law as essential for economic revitalization, job creation, and to attract new investments—especially in factories and industries. Officials emphasize that it also aligns with modern labor practices, supports gender equality, and enhances women’s participation in industrial employment under secure, controlled environments.
